1. Agreement
These Terms of Service ("Terms") are a legal agreement between you ("you", "your") and [COMPANY LEGAL NAME], a company registered at [REGISTERED ADDRESS] ("Quick Loading", "we", "us"). By creating an account or using the Quick Loading web application at qloading.com (the "Service"), you agree to these Terms. If you are accepting on behalf of a company, you confirm you are authorised to bind that company.
2. The Service
Quick Loading is a browser-based tool that calculates and visualises how cargo fits inside a container or truck. You enter cargo dimensions, quantities and weights; the Service produces a three-dimensional load plan, space utilisation figures and weight checks.
The Service is provided as-is for planning and estimating purposes. See Section 10 (Calculations and no reliance).
3. Accounts
You need an account to use the Service. You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. One account is for one person; Company plan seats are for named individuals. You must be at least 18 years old and authorised to act for your business.
We may suspend or close accounts that breach these Terms, attempt to circumvent usage limits, or show signs of automated abuse.
4. Plans, fees and billing
The Service offers a Free plan, and paid plans (Solo, Company, Enterprise) as described on our pricing page. Paid plans are billed in advance in US dollars on a monthly or yearly cycle through our payment processor (Stripe).
Subscriptions renew automatically. Unless you cancel before the end of the current billing period, your plan renews and your payment method is charged at the then-current price. You can cancel at any time from your account settings; cancellation takes effect at the end of the period you have already paid for.
Prices may change. We will give at least 30 days notice of a price increase for existing subscribers, and it applies from your next renewal. Fees exclude applicable taxes, which you are responsible for, except where we are required to collect them.
Usage limits (for example the number of load calculations per month) are described on the pricing page. Unused calculations do not roll over.
5. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
6. Acceptable use
You agree not to: (a) copy, resell, sublicense or white-label the Service without a written agreement; (b) reverse engineer or attempt to extract the source code or the calculation engine, except as permitted by law; (c) use automated scripts to exceed usage limits or place excessive load on our infrastructure; (d) upload unlawful content or other people's confidential data without permission; (e) use the Service to plan loads in a way you know to be unsafe or unlawful.
7. Your data
You keep ownership of the cargo data, SKU libraries, dimensions and load plans you enter ("Customer Data"). You grant us a limited licence to store, process and display Customer Data solely to operate and support the Service.
We do not sell Customer Data, and we do not use your cargo data to train models or to benefit other customers. Your SKU library and load plans are visible only to your own account and, on the Company plan, to the seats in your workspace.
You are responsible for having the right to upload any data you put into the Service, including data belonging to your own customers. Export your data before closing your account; after closure we delete it in line with our Privacy Policy.
8. Intellectual property
The Service, including its software, calculation engine, interface, text and images, is owned by [COMPANY LEGAL NAME] and protected by copyright and other laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes.
Exported load plans, screenshots and PDFs that you generate from your own cargo data may be used freely in your own commercial work.
9. Availability and changes
We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. We may change, improve or discontinue features. If we discontinue a paid feature you rely on, we will give reasonable notice and, where appropriate, a pro-rated refund.
Scheduled maintenance is announced where practicable.
10. Calculations and no reliance
A load plan is a planning estimate, not a certificate of safety or legal compliance. Container payload limits, axle weights, road regulations, port rules, stacking strength, lashing requirements and cargo stability vary by jurisdiction, carrier and cargo. The Service applies the container dimensions, payload limits and stacking rules you select or that are built in by default; it cannot know the condition of the specific container or truck you load.
You remain responsible for verifying the final load against the actual container's plate (including tare and maximum payload), your carrier's rules and applicable law, and for the safe execution of the load. Do not rely on the Service as the sole basis for a booking, a customs declaration or a safety decision.
11. Limitation of liability
To the maximum extent permitted by law, [COMPANY LEGAL NAME] is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost cargo, demurrage, detention, re-booking costs or penalties arising from use of the Service.
Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 100.
Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud or death or personal injury caused by negligence.
12. Indemnity
You agree to indemnify [COMPANY LEGAL NAME] against third-party claims arising from Customer Data you upload, or from your use of the Service in breach of these Terms or applicable law.
13. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access for material breach of these Terms, non-payment, or where required by law. On termination, your right to use the Service ends. Sections 7, 10, 11, 12 and 14 survive termination.
14. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-law rules. The courts of [JURISDICTION] have exclusive jurisdiction, except that either party may seek relief in any court of competent jurisdiction to protect its intellectual property.
Before starting proceedings, both parties agree to attempt to resolve the dispute in good faith for 30 days by written notice.
15. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in-product at least 14 days before they take effect. Continuing to use the Service after that date means you accept the updated Terms.
